Who Are We?

  • These video requests are offered to you by Box Television Limited. Our registered office is at 4th Floor, 40 Bernard Street, London WC1N 1LW and our company registration number is 2643552.  Box Television Limited is the company that in these terms and conditions is called “we” or “us”.

What terms, conditions and rules apply to the video request that I make?

  • These terms and conditions apply to all video requests services offered by us.  Any persons who breach them may be excluded from making video requests.
  • It is important that you read and understand these terms and conditions because they set out the basis on which our video jukeboxes are made available to you, including when your requests may not play.
  • However as each video requests service is a different service and operates in a different way, there may be some terms and conditions that apply only to specific services.  If so, these specific terms and conditions will be set out on-screen or otherwise made clear to you at the time you make your request: for example, the cost of making your request, the cut off time for our receipt of your request, the number to send your request to and so on.

How do I request a video?

  • You can generally make video requests by either text messages or voice calls from your mobile or by calling from your landline telephone.
  • Each individual video requests jukebox will tell you how you can request a video in that particular case and provide you with the relevant telephone numbers or mobile shortcodes to use. We set out below the details that generally apply to each route of entry to make clear what is involved.

How do I make a video request using landline or mobile telephone calls  and how is it charged?

  • We will tell you how much we will charge you for a call from your ordinary landline telephone or from your mobile before you make a video request on one of our video jukeboxes.
  • You should remember that when we state the cost for a landline premium-rate call, we have calculated the cost based on the standard telephone network charges of BT. It may be that your particular operator charges different prices on your telephone network and so you should check these to ensure that you are aware of the total costs that will be applicable to you.
  • Similarly, where we state the cost for a mobile phone premium rate call (or text messages for that matter) we do not include any costs that may be charged by your mobile phone operator and so you will need to check the charges levied by your provider to get an accurate figure for what the call will actually cost.
  • We remind you that calls from phone boxes are more expensive that calls from your home telephone.

How do I enter by mobile text and how is it charged?

  • Where we offer you the chance to request a video using a text message, we will do so on a reverse-billed premium rate basis and charge you on a per-message basis. This means that you first have to send us a text, which you will pay for sending at the normal per-message charge of your mobile phone provider.
  • Then, we will send you back one or more text messages acknowledging receipt of your first text and providing you with information about the video request. You will be charged for all of these  text messages even though we send them to your phone. This is what is meant by “reverse billing”.
    • The cost of the acknowledgment/confirmatory texts that we send back to you will be made clear to you on each occasion that you make a video request on one of our video jukeboxes. However you also need to remember that your mobile operator may add his own costs to this and so the total cost to you may go above the cost stated by us.

Will my video request always play?

    • Video requests are offered to viewers of our television channels at various times during the day. The precise time will vary from channel to channel and from day to day. When the video request phone number, text number and current playlist of tracks available to request are displayed on-screen, the channel is at that time is open to receive requests. Outside of these times any requests made will be charged for but may not play.
    • The channel playlist (which chooses which tracks may be played) is subject to change throughout the day. Please check on-screen where the tracks available for request within the specified programme zone will be displayed.
    • If a track you request has not yet played and the playlist changes, or if your request would result in consecutive tracks being played, your request will not play.
    • Video requests made during periods of set programming chosen in advance or during countdowns may not play.
    • Please note that we cannot guarantee that all requests will be played on air and we do not refund you if your request isn't played.
    • Please also note that a track may be played once in response to several requests.

How much will it cost me to make a video request?

  • Before you make a video request on one of our channels, you will always be told clearly how much it will cost you and the basis on which you will be charged.
    • However on occasions there will be additional charges added by mobile phone or other telephone network operators which obviously we do not control. So if you need to know the total cost you will end up paying, you will need to check whether your telephone network operator will add his charges to ours and what those charges are.
    • Unless stated otherwise on-screen, telephone requests are charged at £1 (one pound) per call from a BT landline. Mobile and other network costs may vary.
    • For mobile text requests, you will be charged £1.50 (one pound and fifty pence) for the delivery of one message sent acknowledging your text request in addition to the standard messaging cost of the relevant network operator for sending the text.

How do I pay to make a video request?

  • If you are a pre-pay mobile user, the charges will come out of your credit balance. If you pay periodic bills for your mobile or landline telephone, they will appear on your next bill or statement.

What if it is not my phone or I do not pay the bills?

  • You should always get the permission of the person who pays the bills before you use a phone (mobile or landline) to enter a premium rate service, particularly if you are a child or young person.

Can I make a request using my television red button and how much does it cost?

  • Freeview (digital terrestrial) television viewers may click on the red button to access pages which provide information relating to various competitions, games and video requests jukeboxes that operate on our “The Hits” channel.
  • You cannot actually enter any competition or play any game or make a video request on the interactive pages that are brought up by clicking the red button, but those pages will generally give you information on the entry routes or video requests opportunities that are available.
  • There is no charge for clicking on the red button and accessing interactive information pages.

What if my request for a video is lost or incomplete?

  • If we do not receive a request from you for us to play any video then we cannot process it, regardless of whether you sent the request to us. Also, if we receive a request from you that is illegible or incomplete  or otherwise deficient we may not be able to process it.

What are the rules about me supplying content?

  • If it is the case that a video jukebox asks you to supply any content – whether it be pictures, text, sound recordings or whatever – the content you supply must comply with the following rules:
  • it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone;
  • it must not harass or bully another person;
  • it must be true and honest so far as you know;
  • it must not be defamatory of anyone;
  • it must not use the material or content or infringe the rights or privacy of anyone else: for example you should not use images of well known characters or music;
  • it must not contain someone else’s personal details or confidential information relating to other people;
  • it must not promote or condone terrorism, violence or illegal behaviour.
  • We reserve the right to refuse to accept or refuse or cease to use any content supplied by any person that we think contravenes these rules.
  • If you are the winner of a competition or game, you agree that you will allow us to use your name and picture in marketing and publicity undertaken by us which may be in more than one country and which may be in a number of media, for example, print, television, internet. We will pay your reasonable expenses if we need you to make yourself available to be used in marketing and publicity of this sort.

What can we do with any material you send us?

  • We will use any pictures, text or sound recordings that you send to us for the purpose of operating the relevant video request.
  • We may also use it for the purposes of promoting our business (for example by putting it on our television channels, mobile services and websites).

How will we use your personal details?

  • We will use your personal details to process the video requests that you make. Where we or other companies in our corporate group want to use your personal details for other purposes (such as marketing) we will offer you the opportunity to agree or to refuse this.
  • Your personal details will be treated in accordance with our Privacy Policy from time to time and in accordance with the law as it relates to people’s personal details.

How far are we liable or responsible to you?

  • Nothing in these terms and conditions removes or limits our liability for fraud, for death or personal injury caused by our negligence or for any liability which cannot be limited or excluded by the law. These terms and conditions also do not affect the rights that are granted to you as a consumer by the law. Otherwise, we will not be liable to you for any matter relating to the video requests offered by us.
  • We will also not be liable to you if you suffer loss or inconvenience because of the failures of persons or systems that we do not directly control – for example, mobile phone network operators, internet service providers, software providers and telephone traffic handlers.

The legal position of these terms and conditions

  • These terms and conditions form a legally binding agreement between you and us. We may change them and update them from time to time but if we do so we will post the changes on this website.
  • These terms and conditions shall be governed by English law unless you live in Scotland in which case Scottish law shall govern, and are subject to the exclusive jurisdiction of the courts of England, Wales, Scotland and Northern Ireland.
